Right of Withdrawa

Right of Withdrawal – Terms, Conditions and Exclusions

 

According to the UK Consumer Contracts Regulations 2013 and the EU Directive 2011/83/EU, consumers have the right to withdraw from the purchase contract without giving any reason within 14 calendar days from the date of receipt of the goods.

 

This right applies only if the products have not been opened, used, tampered with or damaged, and must be returned in their original condition, complete and in the original intact packaging.

 

Withdrawal procedure

 

To exercise this right, the customer must notify their decision in writing within 14 days of receipt to the email address info@torocaffe.com or via registered mail with return receipt / PEC. The request must include the order number and the customer's full contact details.

 

Once the request is validated by our customer service (within 48 hours), the customer will receive return instructions. The goods must be shipped within 7 days of confirmation, to the following address:

Return shipping costs are the responsibility of the customer.

 

Refund

 

The refund will be processed within 14 days of receiving the returned products, provided they are in conformity. The refund will include only the product cost, excluding original shipping and return costs.

 

If the products are found non-compliant (used, incomplete or without packaging), no refund will be issued, and the items may be returned to the customer at their expense.

 

Note: The right of withdrawal described above applies exclusively to final consumers (private individuals). Sales made to business customers with a VAT number (B2B) are excluded from the right of withdrawal under the UK Consumer Contracts Regulations 2013 and EU Directive 2011/83/EU, unless otherwise agreed contractually. Business buyers are not entitled to the same rights as consumers.

 

When the right of withdrawal does not apply

 

  • Opened or partially used food products, as per Article 16 of EU Directive 2011/83/EU.
  • Products returned beyond the 14-day legal period.
  • Damaged or incomplete products, or without original packaging.
  • Machines or electrical appliances that have been used, even partially.

 

Important: Refund requests through third-party platforms (e.g. PayPal) that do not comply with the above conditions will not be considered valid. We strictly apply the rules set by UK and EU law regarding withdrawal and warranty.
